The phototexture feature provides access to certain Google-owned Street View images, which have been authorized by Google to Trimble to enable the creation of phototexted templates (the “Street View Content”). Trimble offers you a personal, worldwide, royalt, non-deductible, non-exclusive sublicense for the use, reproduction, modification, public performance and public display, as well as the creation of derivative works of street View content, as embodied in a template created with the phototexture feature (a “Photo Texture Template”). You should not separate or separate the assignment of Street View content to the model from the photo texture. Without the prior written permission of Trimble or Google, you may not use or distribute a phototexture template in any map or geographic application or in any service (except for a service owned and operated by Google, such as Google Earth). This Agreement shall be governed by Dutch law. The applicability of the Convention on Contracts for the International Purchase of Goods in 1980 is excluded. All disputes that may be settled on the basis of this License Agreement will be decided by the Regional Court of The Hague, Netherlands. This Agreement contains the entire agreement between the Parties with respect to the subject matter of this Agreement and supersedes all prior or simultaneous oral or written agreements or arrangements. (a) the agreement as a whole. These Terms and Conditions represent the overall agreement between you and Trimble regarding the Software and govern your use of the Software.
